GlaxoSmithKline has agreed to pay out $250 million in lawsuit settlements to 5,500 plaintiffs in the Avandia litigation. This will pay an estimated $46,000 to each plaintiff listed in the suit. The amount in the last Avandia lawsuit settlement paid out $40,000 per plaintiff. While the value of the settlements have increased it’s still a fraction of what was expected.
The lawsuits stem back to several years when GSK was facing claims that Avandia caused heart attacks and other cardiovascular problems. The big winner in the suit was Glaxo although their legal bills are estimated at over $3 billion. The settlement amounts in this suit could have ranged from $500,000 to a $1 million per plaintiff if there was concrete evidence that Avandia did cause heart attacks. Instead each plaintiff will walk away well short of those numbers.
Last year the FDA ordered Glaxo to place a label on the drug warning doctors and patients the drug should only be used after other diabetes treatments have failed. While the litigation continues there are still some doctors prescribing Avandia and patients willing to take the drug.
This lawsuit settlement was the second settlement Glaxo made on the Avandia lawsuits.
